Agreement to these terms
These Terms of Service ("Terms") govern access to and use of ChessBulb's websites, applications, and services (collectively, the "Service"). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy, Refund Policy, and Minors Policy where they apply to you. If you do not agree, do not use the Service.
Eligibility and accounts
You must provide accurate registration information. You are responsible for activity under your credentials. Academy accounts may invite staff; each user must comply with these Terms. Where a student is a minor, a parent or guardian may need to authorize use as described in the Minors Policy.
The Service
ChessBulb provides software for chess academies to market programs, manage students and schedules, and deliver live online lessons through ChessBulb Classroom (shared board plus audio; no video in v1). We may add, modify, or discontinue features; we will give reasonable notice for material changes when practicable.
Academy platform subscription and billing
Academies pay ChessBulb a recurring platform subscription in EGP at the tier and price shown on the Pricing page (or in your order), plus applicable taxes. Subscriptions renew until cancelled under the cancellation path we provide. If a renewal charge fails, we may suspend or downgrade service after notice as described in product communications.
Student tuition, checkout, and settlements
Student-facing tuition is charged according to the academy's published packages. Payments may be processed by our payment partners. ChessBulb does not take a percentage of student tuition; remittance to academies is the gross amount minus payment processing fees, after applicable refunds and the per-installment refund window described in the Refund Policy. Nothing in these Terms makes ChessBulb a party to the underlying coaching relationship between a student and an academy, except to the extent we facilitate payments and settlement mechanics described in the product and policies.
Refunds and failed renewals
Refunds on student tuition follow the Refund Policy. For failed student renewals, access may continue for a short grace period and then be suspended as described in product documentation and that policy. Platform subscription refunds, if any, are stated at purchase or in separate terms we provide for that product.
Acceptable use
You agree not to:
- Break the law, infringe others' rights, or harass users
- Interfere with or disrupt the Service, including attempting to access non-public areas or other users' data without permission
- Upload malware or attempt to bypass security or usage limits
- Use the Service to process illegal gambling, hate content, or other prohibited material under applicable law
Intellectual property
ChessBulb and its licensors own the Service, including software, branding, and content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms. You retain rights to content you upload; you grant us a license to host and display that content to operate the Service.
Disclaimers
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim implied warranties where allowed. We do not guarantee uninterrupted or error-free operation, especially for internet-dependent and realtime features.
Limitation of liability
To the maximum extent permitted by law, neither ChessBulb nor its suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability for any claim related to the Service is limited to the greater of amounts you paid to ChessBulb for the Service in the three months before the event giving rise to the claim, or a nominal amount if you have not paid us, except where such limitations are not enforceable.
Dispute resolution and governing law
These Terms are governed by the laws of the Arab Republic of Egypt, excluding conflict-of-law rules. Courts in Egypt have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer that cannot be waived. If a mandatory arbitration or mediation scheme applies, we will follow applicable procedures once confirmed by counsel; this draft may be updated accordingly before commercial launch.
Changes
We may update these Terms. We will post the new version and update the "Last updated" information. Continued use after changes become effective constitutes acceptance. Material changes may require additional notice or consent where the law says so.
